READ THESE TERMS OF SERVICE AS THEY PROVIDE IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND RESTRICTIONS AND A CLAUSE RELATING TO THE JURISDICTION AND VENUE OF DISPUTES.

The following terms and conditions - and subsequent amendments - apply to all our services available online, either directly or indirectly (through distributors), through any mobile device, by email or by phone. By accessing our website, visiting, using and/or using any of the applications available through any platform (hereafter referred to as "website") and/or by completing a reservation, you acknowledge that you have read, understood and accepted the terms and conditions set out below (including the privacy statement).

These pages, their content, their structure and the service of online booking of accommodation provided on them and through this website (the "Service") are owned, managed and offered by Dotstay Srl ("Dotstay", "we", "us", "our/ours") and is provided for your personal use only with non-commercial purposes, governed by the terms and conditions described below.

Certain areas of the Site (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions or may require you to consent and agree to additional terms and conditions. If there is a conflict between these Terms and the terms and conditions posted for a specific area of the Site, Services or Collective Content, the latter shall take precedence in relation to the use of, or access to, that area of the Site, Services or Collective Content by the user.

YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE, YOU ARE INDICATING THAT YOU HAVE READ AND UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU ARE REGISTERED ON THE SITE. IF YOU DO NOT AGREE TO THESE TERMS, YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, SERVICES OR COLLECTIVE CONTENT.

If the user accepts or agrees to be bound by these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.

Key Terms

"Dot"is an intelligent temporary accommodation, useful to all users who need to move to another city. Booking a DOT, from the day of your check-in, the user receives targeted real estate proposals by text message and/or email, in line with its needs.

"Supplier of DOT" means a landlord who rents his entire house or part of his house or an owner and / or manager of the hotel, Bed & Breakfast, or to any temporary accommodation for 1 or more weeks.

"PASS Service"means the notification service via SMS and/or email through which Dotstay helps the user in the search of his long-term house or room, in relation to the data provided by the user in the "Fill out the form" section.

"Content" means any text, graphics, images, music, software (excluding the Application), audio, video, information or other material.

"Guest"means a Member which requires the reservation of a DOT through the Website, or a member who resides in a DOT and is not the owner of this accommodation.

“Ad"means a DOT reported as available to be boooked through the Site, by a landlord, owner and/or operator of Hotels, Bed & Breakfast or owner and/or operator of any temporary accommodation.

"Member" means a person who completes the registration process of his/her Dotstay 's account, including, among others, Landlords, owners and/or operators of Hotels, Bed & Breakfast or owners and/or operators of any temporary accommodation and guests, as described under "account Registration" below.

“Dedicated Area”means the personal account in possession of from where is possible to modify potential informations and personal data, propensity concerning to the type of accomodation, typology of renting looked for and any others functions therein.

"Tax"or "Taxes"means any sales tax, value added tax (VAT), taxes on goods and services (Goods and Services Tax, GST) and other similar municipal indirect tax, state or other withholding tax on personal or corporate income.

Changes

Dotstay reserves the right, in its sole discretion, to modify the Site, or to modify these Terms, including rates of the Services at any time without prior notice. In the event we modify these Terms, we will post those changes on the Site, or we will notify you of the change. We will also update the "last updates" section at the top of these Terms. 

By continuing to access or use the Website after the publication of a modification of the Site either through the application or by sending the notification of a change, you indicate you agree to be bound to these revised Terms. If you believe these changes is not acceptable, the only recourse will be to cease using the Site, Application or Services in question.

Suitability

The Site is exclusively intended to majority persons or aged (18).  Any access or use of the Site by anyone underage (18) is expressly prohibited. By accessing or using the Site, you declare and warrant that you are at least 18 years old.

Scope of Service

Through this website we (Dotstay affiliates and partners (distribution)) provide an online platform that allows all types of temporary accommodation (eg., hotels, bed & breakfasts and private homes) to advertise their rooms for reservation and to the users of the website to make reservations. The rooms publications, whether they are private rooms, apartments, hotel or B&B are defined in DOT. The DOT can be booked for 1 week or multiple of a week from all those users who need to move to another city and need a temporary accommodation as a base to look for a permanent house or room. 

By making a reservation of a DOT through Dotstay, users must fill out a form and send it to Dotstay, indicating all the search parameters of the house or room you want. Users, therefore, upon booking DOT, agree to adhere to the PASS service throughout the duration of the stay booked; the PASS service is a notifications service via SMS or e-mail with targeted real estate offers, provided by private owners, and/or by real estate agents and/or third-party companies or providers of real estate. Users will establish a direct contractual relationship (binding in legal terms) with the Supplier of the DOT and from the above (mentioned) reservation, we will exclusively act as intermediaries between the user, the accommodation owners, real estate agents or third parties providers of properties. We will send the property of the relevant (the) booking details and we will send you an e- mail confirmation for and on behalf of the accommodation. By making a reservation online, users also entitle us to transmit the data provided only to private owners or real estate agencies sun / third party companies suppliers of property, or both , private owners and real estate agents / third parties providers of real estate.

In providing our services, we disclose the data that we have been provided by the accommodation. To all the properties is therefore given access to a Dotstay control panel, of which they are totally responsible for what concerns the updating of rates, availability and other information displayed on our website. Although we provide our service with dedication, we are unable to verify and ensure the accuracy, completeness or correctness of the information, nor can we be held responsible for any errors (including blatant and typographical errors), interruption of service (be it due to failure (temporary and/or partial), repair, upgrade or maintenance of the website or otherwise), for inaccurate, misleading or false information or failure in delivering them. Each accommodation is responsible at all times for the accuracy, completeness and correctness of the (descriptive) information, including rates and availability displayed on our website. Our site is not intended, and should not be seen in this light, to recommend or support any marketed on the same structure , in terms of quality, level of service, classification and category assignment by stars.

YOU UNDERSTAND AND AGREE THAT DOTSTAY IS NOT A REAL ESTATE AGENT, AGENT OR INSURER. DOTSTAY HAS NO CONTROL OVER THE CONDUCT OF SUPPLIERS OF HOUSING (WHETHER THEY ARE OWNERS AND/OR MANAGERS OF HOTELS AND BED & BREAKFAST OR OWNERS AND/OR MANAGERS OF PRIVATE ACCOMMODATION) OR GUEST AND OTHER USERS OF THE SITE, OR ON ANY LODGING AND EXCLUDES ALL LIABILITY IN THIS REGARD.

Our services are available for personal and non-commercial use only. Therefore, it is not permitted to resell, use, copy, deep-link, monitor (eg. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any type of business having a commercial or competitive purposes.

Account Registration

In order to access certain features of the Site, as well as to book a DOT or create an ad, you need to register and create an account ("Dotstay Account ") and become a Member. You can register to use the Services directly through the Site or as described in this section.

The user can also register by logging into their personal accounts of certain social networking sites of third party ("SNS") (including, without limitation, Facebook), each of these accounts is referred to as "Third Party Account", through our website, as described below. As part of the functionality of the Website, the user can connect his/her Account to Account Dotstay third party, in one of the following ways: (i) providing his/her Third Party Account login data of Dotstay through the Site, or (ii) allowing him/her to access his/her third party Dotstay account, in accordance with what is permitted under applicable terms and conditions governing the use of each of these third-party accounts. You declare that you have the right to disclose your data to third-parties in order to access your Account Dotstay and/or to allow access to their third party Dotstay Account (including, without limitation, to be used according to the purpose described herein), without violating any of the terms and conditions governing the use of the account of the applicable third party, and without requiring Dotstay to pay any fees, or make Dotstay subject to any limit imposed by the supplier of Use of third party services. Dotstay allowing access to any Third Party Accounts, you understand that Dotstay will access, make available and archive (if applicable) any Content provided and stored in your Account to the third party ("SNS Content") so that it is available through the Site through your Dotstay Account and the profile page of the Dotstay account. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered parts of Content for all purposes of these Terms. Depending on the account of a third party chosen by the user, and subject to the privacy settings you selected in such Accounts third party, the personal identifying information posted on such third party accounts will be available on and through your Account on the Site Dotstay. Please note that, if a third-party account or an associated service were to become unavailable, or access by Dotstay to such third-party accounts should be completed by the third party service provider, the SNS Content will not be available on and through the Site. The user has the option to disable the connection between his/her Account and third party Dotstay Account at any time by going to the "Settings" section of the Site and Application. 

PLEASE NOTE THAT THE DEALINGS WITH THIRD-PARTY PROVIDERS OF SERVICES RELATED TO THE ACCOUNT OF THIRD PARTIES ARE GOVERNED SOLELY BY SUCH AGREEMENTS WITH ITS THIRD PARTY SERVICE PROVIDERS. Dotstay will not attempt to analyze any SNS Content for any reason, including, without limitation, the accuracy, legality or condition of non-infringement of the same and Dotstay is not responsible for any Content SNS.

IF YOU DO NOT AGREE TO THESE TERMS, YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, SERVICES OR COLLECTIVE CONTENT.

In order to enable the user to use the Site, we will create a Dotstay account and a Dotstay Account profile page for the user, based on the personal information they provide or that we will get through an SNS, as previously indicated. You may not have more than one (1) active Dotstay Account. You agree to provide accurate, complete and relevant information during the registration process and to update such information to keep it accurate, relevant and complete. Dotstay reserves the right to suspend or terminate a user’s Account and access to the Site, Application and Services in the event that the user should create more than one (1) Dotstay Account or if that any information provided during the registration process or later prove to be inaccurate, not relevant or incomplete. The user is responsible for protecting your password. You agree to not disclose your password to any third party and that you will take sole responsibility for any action or activity related to your Dotstay Account, whether or not it has authorized such activities or actions. The user will immediately notify Dotstay any unauthorized use of your Dotstay Account.

The present Terms of Service request to any Member to give careful informations.  Even though Dotstay could, with clearness purpose or prevention or identification of fraud, directly or through third parts, ask to the user to give an identification document given by public authority, the day of birth and others informations, or make controls and conduct additional procedures in the order to verify and check the identity or historiography of members and/or verify members’ informations in the database of third parts or others sources, we don’t formulate any declaration, nor confirm or validate any Members nor his supposed identity or his historiography.

Housing Ads (DOTs)

As a Member, you have the right to create ads. In this regard, the user will be asked a series of questions on the subject of the DOT ad, including, but not limited to, the location, capacity, size, features, availability and price, as well as the rules and related financial terms. In order to be inserted between the ads through the Website, all of the DOT must have a valid physical address.

Ads will be publish in 24 working hours through the Website, upon the verify of completeness and adequacy of the same.

Other members will be able to book the DOT through the Website on the basis of the information provided. You understand and agree that when a guest requires the reservation of a DOT, the price of the booking cannot be changed.

The user acknowledges and agrees on being responsible for all the ads published. Accordingly, the user declaim and warrant that publishing ads, booking a DOT, or staying in an accommodation advertised by the user:

(i) will not violate any agreement established by the user with any third party and

(ii) (a) will be compliant to all applicable laws, tax requirements, rules and regulations applicable to any DOT included in a list published by the user, including, but not limited to, zoning laws and those governing the rental of residential property or properties of any other kind, and (b) will be not in conflict with the rights of third parties. Please note that Dotstay takes no responsibility for the conformity of the Guest to any law, rules or regulations in force. Dotstay reserves itself the right at any time and without prior notification to the user to remove or disable the access to any ad for any reason, including ads that Dotstay in its sole discretion, considers objectionable for any reason, in violation of these Terms or otherwise harmful to the Site.

You understand and agree that Dotstay is not acting as an insurer or contractor, as an agent for the user or as the owner of any facility (DOT). If a guest requires a booking of a DOT’s user and resides there, any agreement with that Guest is an agreement between the guest and the owner and/or operator of DOT, and Dotstay is not a party of that agreement. Regardless of the above, Dotstay acts as authorized agent of the owner and/or operator of the DOT in order to receive payments from the guests in the name and on behalf of the owner and/or operator of DOT and is responsible for the payment of such payments to the owner and/or manager of DOT.

Dotstay suggests owners and/or operators of DOT to take out adequate insurance for their own accommodations. Please examine carefully any insurance policy in its possession relating to the lodging, and in particular please make sure on being familiar with the insurance policy, to understand any exclusions and any deductible applicable to that item insurance policy, including, for example, if the said policy will cover whether or not the actions or inactions of guests (and individuals that the guest invites at the accommodation, if applicable) while it is at the user's accommodation.

Disclaimer of Endorsement

By using the Site, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members or other third parties, will be limited to a claim against the Member in question or other third party responsible for the damage, and the user agrees that it will not attempt to impose liability or seek any legal remedy by Dotstay in relation to such acts or omissions. This limit does not apply to any claim by a Supplier of DOT against Dotstay, relating to remittance of payments that it receives from a Dotstay Guest in the name and on behalf of the Supplier of DOT, and that should be subjected to the limitations described in the following section entitled "Limitation of Liability".

Prices and Rates DOT

The prices on our site are highly competitive. All rates published on the website of Dotstay are for the whole stay of 1 week or multiples of 1 week (2, 3, 4, n. weeks) and are inclusive of VAT and all other taxes (subject to Currency change of such taxes), unless otherwise indicated on the website or e-mail confirmation.

The rates proposed by the accommodation facility do not allow cancellation or refund, in the event of cancellation. It is provided for a partial refund of 50% of the Total Price in case of cancellation preceding the 14 days from the estimated date of check-in

Before making your booking, carefully monitored conditions in the details of the room rates.

The obvious errors are not binding, including those of the press.

All special offers and promotions are indicated as such.

Bookings and financial terms

The fees appearing in each ad are inclusive of DOT Price (as defined below) and the Guest Commission (as defined below). Where applicable, additional taxes may be charged to the price of the DOT and the Guest commission. The price of the DOT, Guest Commission and taxes applicable in these Terms are collectively referred to as the "Total Fees". Please notice that it is the DOT Supplier, and not Dotstay, to determine the price of the DOT.

As payment for the Services given, Dotstay earn commissions only and exclusively from Guests.

Guest’s commission is calculated on the ground of the applicable percentage of the price for the staying in the DOT and it’s add to calculate the Total Commission (including tax) visualized in the ads.

Total commissions are included in Total price.

Dotstay will stop a amount equal to the total commission at the moment of the booking. This amount will remain pre-authorized until 14 days preceding the estimated check in.

It is understood that Dotstay will reserve itself the right to cancel the booking if, for any particular reason not attributable to Dotstay, the credit card will be refuse or there will not be a sufficient amount for making the payment of the DOT.

Total Commission will be completely collected from Dotstay 14 days preceding the date of the estimated check-in.

The payment of the price for the DOT to his owner will be corresponded by 48 ( forty-eight) working hours from check-in at the Guest applicable DOT, through RID, PayPal, direct deposit or other payment method described on the Site.

Dotstay, from the freeze moment of Total Commission for the booking of the DOT, reserves itself, also, the possibility, where expreslly asked from the owner of the DOT, to freeze a amount as security deposit against possible damages or thefts attributable to the Guest.

That amount will be available again on the Guest’s current account once verify the absence of damages attributable to the Guest or to third party connected, anyway not further than 15 (fiftheen) working days starting from the check out date.

In case of damages, Dotstay will take the possibility to charge to Guest the total amount for the reparations or sostitutions.

In order to safeguard and encrypt your credit card information when in transit to us, we use the "Secure Socket Layer" (SSL). In the event of fraud or unauthorized use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or unauthorized use. However, this could result in a deduction (usually corresponding to EUR 50 or the equivalent in your currency). In the event that the company that issues your credit card or the bank will also charge this amount because of unauthorized transactions resulting from a reservation made on our website, we'll compensate you for that amount, up to an amount of EUR 50 (or the equivalent in your local currency). In order to perform the compensation, be sure to report the fraud to the credit card provider (in accordance with its rules and procedures) and contact us immediately by e-mail (info@dotstay.com). Indicate as an object of the e-mail "credit card fraud", providing evidence of the excess charged (eg. Policy of the issuer of the credit card). This compensation applies only to reservations that have made use of secure server Dotstay and only after having verified that the unauthorized use of your credit card has been a consequence of default or from an act of negligence on our part and not your misuse of the secure server.

Booking and Financials Terms for Landlords

DOT’s owners agree with the type of instant reservation, under which any Guest has the possibility of renting directly from the Site without any kind of preventive agreement from the Owner.

In case of, due to malfunctioning of the site or in overbooking case, not attributable to Dotstay, the booked DOT wouldn’t be available during the choosen period, Owners will be committed to give well-timed communication to Dotstay email adress.

It’s considered a must from the Owner to communicate to Dotstay the availabity of his/her DOT, refreshing the dedicated calendar.

In the case in which the Owner couldn’t be able to receive the reservation and the Guest woludn’t accept another solution given by Dotstay, any amounts collected from the Owner will be refund. The provider of DOT accepts that Dotstay can discretionary interrupt the collaboration and suspend the Account after the third refusal from the supplier of the DOT.

Appointment of Dotstay as an agent responsible for payments to the Supplier of DOT.

With this, the DOT Supplier provisional appoints Dotstay as their agent for the sole purpose of collecting the payments made by the guests on their behalf. DOT Suppliers agree that the payment made by a guest to Dotstay will be deemed to be a payment made directly to the DOT supplier; DOT supplier shall put the DOT available to the Guest as stipulated above, as if the DOT Supplier had received the payment of the DOT. In accepting the appointment of provisional authorized agent for the Landlord, Dotstay assumes no responsibility for any actions or omissions of the DOT Supplier.

Please note that Dotstay currently does not charge commissions for the creation of ads.

Bookings and financial terms for Guests

Suppliers of DOT, and not Dotstay, are solely responsible for honoring any confirmed reservation and to make available any DOT booked through the Site. If you, as a guest choose to enter into a transaction with a DOT Supplier for booking a DOT, you agree and understand that you will be required to enter into an agreement with the DOT Supplier and agree to accept any of the terms, conditions, rules and restrictions associated with that imposed by the Supplier. You acknowledge and agree that the responsibility of the fulfillment of these agreements falls upon yourself, and not on Dotstay, that Dotstay is not part of the agreements, and that, although the payment obligations under this document, Dotstay excludes any liability arising out of or relating to such agreements. 

You acknowledge and agree that regardless of whether Dotstay is not part of the agreement between himself and the Supplier of DOT, Dotstay will act as agent in charge of the payments of the Supplier of DOT for the sole purpose of accepting payments by the user to his name and for its own account. Following payment by the user to Dotstay of the amounts remited to the Supplier of DOT, the user's obligation to pay to the Supplier of DOT for these amounts will be extinguished and Dotstay will be responsible to pay to the Supplier of DOT these sums. In case Dotstay does not pay such amounts to the Supplier of DOT, the Supplier of the Dot will complaint exclusively against Dotstay.

Please note that Dotstay cannot control any fees charged to a guest from your bank with regard to the collection by Dotstay of the Total Commissions, and Dotstay excludes all liability in this regard.

In relation to your booking request, you will be asked to provide the usual billing information, such as, for example, name, billing address and credit card information to Dotstay or the third party that processes payments. You agree to pay any Dotstay confirmed reservation made in connection with your Dotstay Account in accordance with these Terms by one of the methods described on the Website, such as through PayPal or by credit card.

With this, the user authorizes the collection of such sums by direct debit on the credit card provided within the process of inquiry, directly by Dotstay or indirectly through a third-party online payment processing or by one of the payment methods described on the Site. You also authorizes Dotstay to perform a charge on your credit card in case of damage caused to a DOT, as provided in "damage to the DOT" below. If the user is directed to a third party for processing your payment, you may be subject to the terms and conditions governing the use of the services and practices of acquisition of personal information by such third party. Please analyze these terms and conditions and privacy policy before using the services. Upon completion of the confirmed booking transaction, you will receive an e-mail confirmation of the confirmed reservation.

GENERAL FINANCIAL AND BOOKING TERMS

Cancellations and Refunds

The DOT booked through the website cannot be cancelled.

The Members accecpt that any reservation cancelled 14 (fourteen) days before the expected check-in will legitimate Dotstay to hold 50% of the total amount due.

Any reservation canceled less than 14 (fourteen) calendar days from the date of scheduled check-in will legitimate Dotstay to hold 100% of the Total Commissions.

To the Dot Provider will be given the 50% of the Total Price of the Dot within 48 (forthy-eight) hours from the date of the estimated check-in. The Dot Provider won’t release claims toward Dotstay on the part of the Total Price no perceived

In case this amount will not be available on the credit card and/or in case the credit card will not be accepted, for any reason, Dotstay has the right to command the realization of the payment and to undertake any legal action in order to recover the amount due to Dotstay.

If a landlord cancels a confirmed booking via the Site, (i) Dotstay will refund the total price applicable for such cancellation to the guest within a reasonable period of time from the cancellation and (ii) the Guest will receive an e -mail or other communication from Dotstay containing alternative DOT and other related information. If a landlord cancels a confirmed reservation and the user, as a guest, does not receive an e-mail or other communication from Dotstay, please contact Dotstay on the site http://www.dotstay.com/home/contacts.

Taxes

You understand and agree that you are the only one responsible for establishing you own applicable tax obligations declaration in consultation with your tax adviser. Dotstay cannot offer and does not offer tax advice to any member of the Site. In addition, please note that each DOT Supplier is responsible for establishing the local indirect taxes and including any applicable tax to be paid or obligation related to taxes applicable in the ads. Where relevant, in the event that the Supplier of DOT is a Landlord and the information upon request, Dotstay can issue an invoice with VAT upon the Landlord’s request.

Damage to the DOT

As a Guest, you are responsible to leave the DOT in the condition in which you found it on your arrival.

Dotstay, at the “pre-authorization” time of the Total Commissions due for the reservation of the DOT, reserv itself the possibility, when expressly asked from the Supplier of the DOT, to freeze an amount as safekeeping deposit in order to prevent damages or thefts imputables to the Guest.

The Supplier of the DOT is required to, within 48 hours from the check-out of the Guest, to communicate and certify possible damages imputable to the Guest during the stay.

The user acknowledges and agrees that, as a Guest, he/she is responsible for his/her own acts or omissions and the acts or omissions of any individual who he/she invites, or who is otherwise allowed to access in the DOT.In the event that the DOT Supplier is a Landlord and complains and provides proof of damages, including, without limitation, damage to photographs, you agree to pay the cost of replacing the damaged items with items of equal value. Once notified of the complaint and obtained forty-eight (48) hours to respond, the payment will be charged and collected by the credit card stored in the Account Dotstay user. Dotstay reserves the right to charge the user’s credit card stored in the Account Dotstay or otherwise collect payment from the user, and to pursue any means available to Dotstay in this regard, including the use of security Deposits, in cases where the user had the intention, at the sole discretion of Dotstay, to inflict any damage to the DOT. If we are unable to charge the credit card on file or otherwise collect payment by the user, the user agrees to make payment for any damage caused to the DOT, the Landlord or applicable to Dotstay (if applicable). Both the guests and the Supplier/Provider of DOT agree to cooperate and assist Dotstay in good faith, as well as to provide Dotstay with all the information and take all actions reasonably requested by Dotstay in connection with any claim or claims made by Members concerning the DOT or any personal property or other property generally located at a DOT or regarding any investigation undertaken by Dotstay or by a representative of Dotstay regarding the use or misuse of the Site.

The user, as a Guest, agrees that Dotstay reserves the right, in its sole discretion, to submit any claim which falls under the insurance policy of the Landlord, or any other insurance policy related to loss or damage to a DOT or any other personal property or other generally located at the DOT that you may have caused or of which you have been responsible.

Conduct of Members

The user agrees to be solely responsible for compliance with any law, rule, regulation and tax liability that may be applicable to the use of the Site, Application, Services and Content. In connection with the use of the Site, Application and Services by the user, the user can not, and agrees that he/she will not do the following:

• violate any local law or regulation, state, provincial, national, or other law or regulation or any order of a court, including, without limitation, zoning restrictions and tax laws;

• use software, devices, scripts robots, other means or manual or automated processes to access, run the "scrape", "crawl" or "spider" to web pages or other services contained in the Site, Application, Services or Content;

• Use the Site for any commercial purpose or any other purpose that is not expressly permitted by these Terms;

• copy, store or otherwise access any information contained on the Site for purposes that are not expressly permitted by these Terms.

• violate the rights of any person or entity, including, without limitation, intellectual property rights, privacy, publicity or contractual rights;

• interfere with or damage our Site, including, without limitation, through the use of viruses, cancelbots, trojan horses, malicious code, flood pings, denial- of-service attacks, packet or IP spoofing, forged routing or information on e-mail addresses, or similar methods or technology;

• use our Website to transmit, distribute, post or submit any information concerning any other person or entity, including, without limitation, photographs of others without the permission of those concerned, personal contact information or credit cards or debit cards, prepaid cards or account numbers;

• use our Site in connection with the distribution of unsolicited commercial e-mail ("spam") or advertisements not related to housing in private homes.

• offer, as Landlord, any DOT not personally owned and that you do not have permission to rent the property as residential or other (without limitation to the foregoing, the user will not publish ads DOT as Master of home if he served as an agent for the leasing or sale to a third party);

• offer, as Landlord, any accommodation that you cannot rent or sublet in accordance with the terms and conditions of an agreement with a third party, including, but not limited to, a lease of property;

• register with more than one Dotstay Account or register for a Dotstay account on behalf of an individual other than yourself;

• impersonate any person or entity, or otherwise misrepresent yourself or your affiliation with any person or entity;

• use automated scripts to collect information or otherwise interact with the Site;

• use the site to find a DOT Supplier or a guest, and then complete the booking of a DOT regardless of the Site, the Application or the Services in order to circumvent the obligation to pay any Service Commission related to the provision of the Services by Dotstay;

• forward, as DOT Supplier, any ad that contains a false or misleading price, or publish any advertisements with a price that you do not intend to maintain;

• publish, upload, post or otherwise transmit any Content that: (i) infringes or misappropriates the rights of any third party patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy, (ii ) violates , or encourages any conduct that would violate any applicable law or regulation or which would give rise to civil liability, (iii) is fraudulent, false, misleading or deceptiv ; ( iv) is defamatory, obscene, pornographic, vulgar or offensive; ( v) promotes discrimination, bigotry, racism, hatred, harassment or harm to groups or individuals, (vi ) is violent or threatening or promotes violence or actions that are threatening to other people; or ( vii) promotes illegal or harmful activities or substances;

• systematically acquire data or other content from our Site to create or compile, directly or indirectly, in single or multiple downloads, collections, compilations, databases, directory or the like, either by manual methods, orthrough the use of bots, crawlers, spiders, or others.

• use, display, publish , "mirror" or "frame" the Site , or any individual element within the Site, the Services or the Application , the name of Dotstay, any Dotstay trademark , logo, or other information, or the layout and design of any page or form contained on a page without the written consent of Dotstay;

• access, tamper with, or use non-public areas of the Site or Application, Dotstay computer systems, or the technical delivery systems of Dotstay providers;

• attempt to probe, scan or test the vulnerability of any Dotstay system or network, or to violate any security or authentication measures;

• avoid, bypass, remove, deactivate, damage, reverse engineer or otherwise circumvent any technological measure implemented by Dotstay or any Dotstay provider or any third party (including another user) to protect the Site;

• forge any TCP/IP header peace or any part of the header information in any e-mail or newsgroup posting, or in any way use the Site, Services, Application or Collective Content for the purpose of sending misleading or false information identifying the source;

• try to decrypt, decompile or uninstall any software used to provide the Site, Services, Application, collective Content;

• defend, encourage, or assist any third party in the performance of any activity referred to above.

Dotstay have the right to investigate and take legal actions in the event of a breach of any provision hereof to the maximum extent permitted by law. Dotstay has the right to involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms. You acknowledge that Dotstay has no obligation to monitor your access to or use of the Site, or to analyze or modify any content, but has the right to do so in order to operate the Site, to ensure user compliance with these Terms, or to comply with applicable laws or by a resolution of a court, administrative agency or other governmental entity. Dotstay reserves the right at any time and without prior notice, to remove or disable access to any content that Dotstay, considers in its sole discretion objectionable for any reason, in violation of these Terms or otherwise harmful to the Site.

PASS SERVICE

Terms and conditions of PASS

As a guest at the DOT, from the moment of checking-in, the user will receive notifications by Dotstay via SMS or e-mail relating to real estate offers related to its requests, and they will be sent through the Dotstay Site in the "Fill out the form". Proposals submitted may be related to properties offered by private owners or real estate agencies/companies providing real estate.

Real estate offers sent to you are meant to meet to your requirements according to variable indices of affinity, estimated to 100%. These proposals are gathered by third-party companies and web portals third party and conveyed in the Dotstay database. Dotstay guarantees that these properties offered are available at the time of the notification or, at least, within and not further 7 (seven) days from the asked check-in data in the flat required from the user. 

The user expressly authorizes the disclosure of personal data to third parties only in order to facilitate the matching of supply and demand. Dotstay is committed to providing the best service in order to provide the most appropriate means to achieve the objective of the user, but is not responsible and therefore gives no warranty of any kind in relation to the successful outcome of negotiations resulting from the interaction between the user and the private owner or real estate agency, following the sending of the notification by Dotstay PASS via email and / or SMS.

Dotstay also does not guarantee the individual character of other users. Dotstay cannot be held responsible for anything that occurs or any loss arising from the use of our website. It is your responsibility to determine the character and veracity of the potential roommate, or owner of the house.

Modification of Terms and Cancellation of Dotstay Account

We may, at our own discretion and without your liability, with or without cause, with or without notice, at any time: (a) modify the conditions of these Terms or access to our Website by the user, and (b) deactivate or cancel your Dotstay user account. In the event that Dotstay changes these Terms or access to the Site by the user, or disable or cancel your Dotstay user Account, you will remain liable for all the expenses that are due. Indemnity

The user agrees to spare, defend, indemnify and hold Dotstay and its subsidiaries and affiliates , and their officers, directors, employees and agents free from any claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way related to (a) access or use of the Site or the collective Content by you or violation of these Terms by you, (b) the Content of the user members, and (c) any of the following actions taken by the user (i) interaction with any member, (ii) the reservation of a DOT, ( iii ) the creation of an Ad (iv) usage, condition or lease of a DOT, including, without limitation, any injury, loss or damage (for damages, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the rental, booking, or use of a DOT.

By making a booking you accept to receive (i) an e-mail shortly before your arrival date, including information on your destination and various tips and special offers (even by third parties, if you have provided your consent) relating to your booking and destination (ii) an e-mail after your holiday, with an invitation to write your comment on the facility and (iii) notification via SMS and/or e-mail with suggestions to help in your real estate search in your new house and/or room. Guest Ranking

The default ranking of accommodation on our website is 'Good' (or equivalent formula) (the "Default Ranking "). It is based on a scale from 1 (bad) to 5 (excellent) and does not have any kind of link with the official classification of temporary accommodation on the site.

The ranking provided by the host could be (a) loaded on the page of this accommodation on our website in order to provide (future) customers on your point of view about the (level of) service and the quality of the facility and (b) (wholly or partly) used and placed by Dotstay Srl in its sole discretion (eg. reasons related to the marketing, promotional purposes or to improve the service), on the website or on the platform of social networks, the newsletter, in case of special promotions, apps or other channels owned and hosted, used or controlled by Dotstay Srl.

Disclaimer of liability

Subject to the limitations and the details provided in the circumstances set out in these terms and conditions and to the extent permitted by law, we shall be liable only for damages due to a shortcoming of our obligations in relation to the services that we would have to perform. The compensation may be up to the total cost of your reservation as set out in the e-mail confirmation (or for one event or series of connected events).

In case of dispute or inconsistency or discrepancy between the Italian and the translations into other languages of these Terms, the Italian text shall prevail and will be the final version. The Italian text is available on our website (by selecting the Italian language) or will be sent upon written request.

In the event that any provision of these Terms and Conditions is invalid, lose validity, is or becomes non-binding, you will continue to abide by all other terms set out herein. In that case we will replace the clause with a clause that is valid and binding, which has an effect as close as possible to the replaced and that you agree to accept in accordance to the content and purposes of these Terms and Conditions.

PASS PREMIUM TERMS AND CONDITIONS

The following terms and conditions - and their possible subsequent changes - apply to all our services available online, directly or indirectly (i.e. through distributors), accessible through any mobile device, via email or by phone. By accessing our website www.dotstay.com or using the applications available through any platform (hereinafter all referred to as the "Site") and/or by completing a reservation, you acknowledge that you have read, understood and accepted the terms and conditions of Dotstay (available here) and the terms and conditions of Dostay Pass Premium set out below, including the privacy policy.

These pages, their content, their structure, the service of online booking of accommodation provided thereon and through the Site and the Service for a fee (referred to as the "Services") are owned, managed and offered by Dotstay Srl. ("Dotstay")and are provided for personal use and non-commercial purposes, governed by the terms and conditions described below.

YOU ACKNOWLEDGE, BY ACCESSING OR USING THE SITE, THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS, although you are not registered on the Site. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT ENTITLED TO access or use the website, services and collective content which is to be found therin.

If the user accepts and declares to be bound by these terms and conditions on behalf of a corporation or other legal entity, s/he guarantees that s/he has the authority to bind the company or other legal entity to these terms and conditions and in such a case, the terms "user" and "his" will refer and apply to that company or other legal entity.

ART. 1 – The Service

The user agree and declare on being informed by Dotstay a maximum of 5 accommodation options in 7 calendar days, according to variable affinity indexes between 80% and 100% with the search criteria specified by the user and entered into the online form on the Website. In this index of affinity aesthetic factors and/or formal ones which cannot be evaluated according to objective criteria, and which go beyond the search criteria provided in the appropriate online form on the site, shall not be considered. Dotstay will always and in any case guarantee the compliance with the maximum budget indicated by the user and the type of accommodation required, and these two factors will not be considered as a useful criteria to achieve 80-100% similarity index, because they are always guaranteed.

ACCEPTING THE TERMS OF THIS ARTICLE, THE USER ALSO ACCEPTS THE MATCHING RATE 80-100%, WHICH CANNOT THEREFORE BE CONTESTED FOR ANY REASON.

The user accepts that all the apartments which will be shown to him/her will be in the boundary selected during the compilation of the online form. The minimun distance will never be lower to 1.5km from the point of interest of each city and will be subject to a margin of error equal or lower than 500mt.

The user agrees that the 5 (five) housing options that Dotstay offers will be provided by private owners or real estate agents or by both.

ART. 2 – Dotstay Angel

The user will have the possibility to choose a personal Dotstay Angel assistant (hereinafter "Dotstay Angel"),who will go with him/her to visit rooms/apartments, serving as interpreter with roommates/owners, and helping the user at the time of the contract lease.

Dotstay Angel will be available for any kind of need for 7 (seven) days after check-in in the option chosen by the user.

The omit selection of Dotstay Angel in the dedicated Reserved Area within 7 (seven) days from the activation of the Service leads the assignment of a Dotstay Angel by the office.

ART. 3 – Service Kick-of and Documents

The user agrees that the service will start on the date selected by him/herself, and never before the working day following the payment, and is committed to that moment to be in possession of the required documents - a valid passport (extra EU), Visa (extra EU), receip of the residency permit (extra UE) identity card (EU) and the tax code (codice fiscale) – which is mandatory under Italian law for the valid signature of the lease.

ART 4 – TAKE OR JUMP

The user accepts the formula "Take or jump"in the selection process of accommodation: this will allow the user to confirm the accommodation viewed or go directly to the next one, at the time of the viewing. The user will also have the opportunity to visit all the five options of accommodation guaranteed in 7 days, but accepts that Dotstay cannot be held liable if, due to any delay in the decision of the user, the housing option selected will not be available. The user is willing to view the accommodation options provided by Dotstay and will be punctual in responding to text messages and confirm appointments notified by Dotstay.

ART 5 – TOURS AND APPOINTMENTS

Whether the user should have commitments for work or study purposes during the week of the service, he/she will have to update the schedule of available slot in the specific Reserved Area or, in case of website mulfuction, to send and an e-mail at info@dotstay.com.

The schedule which is present in the customer’s Reserved Area indicates the days of the supply of the Service with 4 time slots of availability (9-12; 12-15; 15-18; 18-21). The user is obliged to select at least 2 of the 4 available time slots in order to grant to Dotstay the possibility to provide a fluid and fast Service. The user has the discretion of choosing only one day of total absence during the week of the Service. This aforementioned schedule can be completed within 24 hours from the activation of the Service and won’t be susceptible of variations except for serious and certified reasons. It is intended that in case the user doesn’t select his/her availabilies within the above-mentioned term, this person will be considered free at any time and day.

Dotstay is committed to arrange appointments on his/her behalf in accordance with the instructions received from the user. The user declares that he/she is aware of the fact that he/she will lose - with no possibility of recovery - the option proposed by Dotstay if he/she will not be present at the appointment for the viewing of rooms/apartments with his/her Dotstay Angel, at the time shown by the availability schedule provided.

If user, after possible sollicits coming from his/her Dotstay Angel, will not confirm the appointment within 45 (fortyfive) minutes from the fixed appointment, tour will be discretionaly cancelled and the option will be considered lost.

Notifications related to appointment setted by Dotstay for the tour of the options will be always communicated with at least a 2 (two) hours warning from the hour settled for the appointment.

In case the notification for an appointment should be sent in less time than the one above, user will have the possibility to refuse the appointment without considering the option as lost.

Option will be considered lost with delay larger than 35 (thity-five) minutes.

Users commit to, furthermore, to obtai an italian tepephone number as soon as possible or to be reachable at any time during the week Service.

Dotstay will be able to suspend the Service when the communication with user turns out to be impossible or, at least, too much hard.

The Service will be relieved in case the user informs by putting into writing to be unable to be present at the appointments due to objective and certified health reasons. The Service can be reclaimed in the same state that was before its interruption in any day (not non-working days) within a month from the communication of the suspension of the Service. The owed amount will remain locked on the payment method selected for the entire period of the suspension. In the event that the user doesn’t communicate the wishes of reclaim the Service in the above-mentioned terms and, after a potential request, Dotstay will be legitimated to collect the 50% of the owed Amount.

N.B. When the service has been purchased from friends/relatives looking for an apartment to be shared, all the persons concerned must be present at the apartment viewing Otherwise, Dotstay cannot guarantee the success of the service.

ART. 6 – Confirmation of chioce

The user agrees that when he/she decides to take the room/house he/she saw, he/she will be asked to pay a symbolic fee to the owner as an advance of the deposit, in order to confirm the choice and prevent the room/house from being selected by other users. The Dotstay Angel will ask the user to send an email to formalise the acceptance of the viewed accommodation. From that time, the research phase of the Service has to be considered as completed.

If within 2 (two) hours from visiting the housing option, the user’s response should be positive but the housing option should not be available and that will not depend neither on the user’s will nor on Dotstay but only from the owner’s decision, Dotstay will not consider the viewed housing option as valid; therefore it will not be counted as one of the 5 weekly options.

ART. 7 – Access to the chosen accommodation

The user agrees that, although the accommodation selected is immediately available, he will not be allowed to check into it until he/she has completed all the procedures established by Italian law regarding lease (payment of the deposit and the current month rental amount, conclusion of the contract, connections with utilities: electricity, water, gas etc.). The activation of the internet line, for which the user will be assisted and guided by his/her Dotstay Angel, will require technical times that depend exclusively on the operator/provider/supplier company the user has been chosen, and Dotstay will not be responsible in any case for any delay from other company or provider. When the service is delivered in the third decade of the calendar month, the user agrees that the accommodation will be available, starting from the day 1 of the next calendar month, although beyond the official deadline of the service.

ART. 8 - Limitation of liability

The user agrees and declares to be aware that Dotstay is committed to offering the best service in order to provide the most appropriate tools in order to achieve the goal, but it is not responsible, and therefore does not provide warranties of any kind, concerning the positive outcome of any agreements or negotiations between the user and the owner of the property and/or roommates, after the user checks in the selected accommodation.

The user agrees that Dotstay will not be held responsible and, therefore, does not provide warranty of any kind, in relation to the behaviour of owners and/or roommates, their religious, sexual or any other kind of orientation.  Dotstay is not responsible for any dispute between the user and his/her roommates and/or home owners, following the check-in in the selected accommodation.

User, furthermore, relieve Dotstay from any responsibility in case the asked data for check-in is greater than 20 (twenty) days from accomodation tour and the owner asks the payment for the period between above-mentioned date and the room/accomodation check-in date.

ART. 9 – Booking and payment

Users has lots of different payment methods to go through the Service reservation.

Different payment methods from those below are not allowed.

Credit card

Booking of any kind of Service could be done by credit card.

Dotstay accepts network credit card from VISA, MasterCard, American Express, Maestro.

From the moment of reservation, Dotstay will take data of above-mentioned card, without charging any kind of amount.

Dotstay will use the information given in order to hold the right amount of money corresponding to the Total amount due. This will be hold for 21 (twentyone) days except for cases in which the Service and/or the dates will be changed so to legitimate an extension of the hold.

In order of the particular rules fixed by by the different credit cards broadcaster, Dotstay will create different autorizations in order to guarantee the availability of the necessary funds for the Service payment.

If, for any reson that can’t be attributed to Dotstay, the amount will result anavailable or the credit card will be refuse, Dotstay will interrupt or suspend, by its own discretion, the Service and go through any legal action in order to receive all the payments.

User accept, therefor, that Dotstay obtain credit card datas and successively use it to go through the right closing of the Service or with the purpose of applying the early cancellation rules.

In particular, Service will be considered positevely closed when the custumer send us the agreement on the apartment shown. In 72 (seventytwo) working hours from the receiving of above-mentioned agreement, Dotstay will vharge the amount for the Service.

As to guarantee the security of payment on the Website and to prevent possible fraud, we will ask to the user, via e-mail, to send, a both side copy of the identity card and, if the purchase holder is different from the credit card holder, to send a identity card copy of this one. The document must be valid. Details for the deadline will be asked in the e-mail from Dotstay. This deadline will not, in any case, be more than 5 working days from when the request is made from Dotstay to the user. While waitin for the documents, Service will be suspended. The user is responsible for sending the required documents within the time specified.

In case Dotstay does not receive these documents within the time specified in the e-mail, or in case it receives expired or invalid documents, the contract will be terminated in accordance with art. 1456 cc, and consequently the order will be cancelled and subject to the right of Dotstay to compensation for any damage which it may incur as a result of conduct inconsistent with the user.

In case Dotstay will receive the valid documents required timely, the deadlines applicable to the order shall be effective from the date in which such documentation is received.

Dotatay reserve the possibility, at any time, to rescind the contract in accordance with the ART. 1456 c.c., in case credit card will be refused for any reason.

PAYPAL AND BRAINTREE

Dotstay use PayPal Inc.safe service payment, that use the SSL security protocol. Relevant credit card datas (credit card number, holder, security code) are encrypt and trasmitted in this way to payment manager.

In case user choose PayPal payment (specifically the Braintree online payment) he will be redirected to the site where www.paypal.it carry out the payment of the Service in accordance with the procedure provided for and governed by PayPal and the terms and conditions of the contract agreed upon by the user with PayPal.

Data entered on the website of PayPal will be processed directly by itself and will not be transmitted or shared with Dotstay, except different cases provided by this Terms and Conditions.

During the reservation, PayPal will acquire and hold necessary data as to complet the payment.

Dotstay will ask to PayPal to freeze the amount 14 (fourteen) days before selected data for the Service activation.

User accept that Dotstay freeze the amount as to guarantee the availability of the funds for the Service period and for the week before. Authorizations numer asked from Dotstay depend exclusively on rules fixed by different credit card broadcaster.

User agree to make available a amount alike the Total for a period of 15 (fifteen) working days starting from the first authorization asked by Dotstay (coinciding with the seventh day before Service starts), otherwise Dotstay is free to cancel the service as stated in the article 1453 c.c.

If at the first attempt of payment authorization the amount expected is not available, Dotstay will contact the user by email in order to finalize the payment within 3 days. In case the user does not make any payment the contract will be considered ended.

It is understood that if the activation Service data should coincide with one above- mentioned three days, Dotstay will be able, at its own discretion, to refuse or to delay the Service, as stated in the article 1460 c.c.

User agree that the Service activation data could be postponed if, for any particular reason unconnected with Dotstay, the amount authorization would result impossible.

The user accepts the early payment of the temporary accommodation (“DOT”), which will be charged the day of the check-in in the Dot. In case of late payment, Dotstay is not responsible for an eventual unavailability of the accommodation.

ART. 10 – Cancellation Policy

Once the user makes the reservation, he accepts that Dotstay will “pre-authorize” the amount due starting from the fourteenth day before the beginning of the service.

There will be no payment if the user cancel, for any reason, the reservation of the service within 14 (fourteen) days from the start of the service. In case of cancellation, the user has to make it through the specific command in the Reserved Area or, exceptionally, he/her has to communicate so to Dotstay through email at info@dotstay.com

In case the user cancel the service between the fourteenth and the day before the beginning of the service, Dotstay will hold 50% of the total amount due.

The same will be hold in the following cases:

I.  In case one or more of the 5 options is missed.

II.In case the user quit during the week of the service

This penalty will not be applied in case of serious and certified reasons, like: cancellation of the univrsity course, moving reason, bereavement in the family, serious health issues.

Dotstay will hold the total amount in the following cases:

I.  The user change needs regarding the accommodation during the week of the service

II.The user does not respect the Italian law fro what concerns documents, contract and fee regarding the rent of the accommodation

III.  The user, once ended the service and sent the agreement, cannot sign the contract for reason in which Dotstay is not responsible

IV.  The user cannot solve the payment requested by the landlord once the agreement, in order to block the accommodation, has been sent

Dotstay will not charge the customer in case him/her will not confirm any of the apartment visited or in case Dotstay will not show the user 5 options in 7 days.

The user, is committed for 30 days following the end of the service, to not sign any contracts regarding apartment and landlords visited and met with Dotstay.

ART. 11 – Applicable Law

The user accepts the adoption of the Italian law for what concerns renting, deposit and payment of the accommodation. The user declares to understand that anything related to the rent, just mentioned, would not be under the responsibility of Dotstay.

According to the article n.1341, comma secondo, the user declares to accept the following clause stated in Terms and Conditions: 5.4 (confirmation of the choice); 8 (limitation on Dotstay responsibility); 10 (refund); 11 (applicable law)

FREE SERVICE - TERMS AND CONDITIONS

The following terms and conditions - and their possible subsequent changes - apply to all our services available online, directly or indirectly (i.e. through distributors), accessible through any mobile device, via email or by phone. By accessing our website www.dotstay.com and/or using the applications available through any platform (hereinafter all referred to as the "Site") and/or by completing a reservation, you acknowledge that you have read, understood and accepted the terms and conditions of Dotstay (available here) and the terms and conditions of Dostay Pass Premium set out below, including the privacy policy.

These pages, their content, their structure, the service of online booking of accommodation provided thereon and through the Site and the Service for a fee (referred to as the "Services") are owned, managed and offered by Dotstay Srl. ("Dotstay")and are provided for personal use and non-commercial purposes, governed by the terms and conditions described below.

YOU ACKNOWLEDGE, BY ACCESSING OR USING THE SITE, THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS, although you are not registered on the Site. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT ENTITLED TO access or use the website, services and collective content which is to be found therin.

If the user accepts and declares to be bound by these terms and conditions on behalf of a corporation or other legal entity, s/he guarantees that s/he has the authority to bind the company or other legal entity to these terms and conditions and in such a case, the terms "user" and "his" will refer and apply to that company or other legal entity.

ART. 1 – The service

The Dotstay Free Service (“Service”) allow the user to receive from Dotstay, during the week stay in a DOT (as given by General Condition of Dotstay) duly booked on the Website, a maximum of 5 (five) accomodations options in 7 (seven) sola days according to variable affinity between 80% to 100% with the search criteria specified by the user and entered into the online form on the Website.

Dotstay will always and in any case guarantee the compliance with the maximum budget indicated and the type of accomodation required, and these two factors will not be considered as a useful criteria to achieve 80%-100%.

The user agree that the 5 (five) housing options will be offered by private owners or resal estate agents or both.

ART. 2 – Accommodation availability

Dotstay guarantee that the options are relevant to real estate available at the moment of the sending the notification, that is whitin and not further 7 (seven) days from the selected data for the check-in in the new accomodation.

User accept that Dotstay has no responsbility on the availability of the real estate in case the user get in touch with the accomodation’s owner and/or real estate agency named in the notifocation in a following period from notification sending. User, furthermore, relieve Dotstay from any responsability in regard to quality, veracity, security, or accuracy of the contents declared in the sent notification.

ART. 3 – Notification and visit

Dotstay will send 5 (five) notifications during the 7 (seven) solar days of users stay in the DOT.

Notifications will be send via e-mail and/or SMS. Users accept to relieve Dotstay from any responsability in the case where the e-mail adress and/or telephon numer is turns out be proved to be wrong or not reachable for any reason not imputable to Dotstay.

User undertake, furthermore, to be reachable for any kind of communications. Dotstay will be able to, at its complete discretion, suspend the Service when the communication with user turns out to be impossible or, at least, too much hard.

Once received the notification, user will have to get autonomously in touch with the pwner of the accomodation and/or real estate agency therein mentioned for visit the accomodation as well as start potential negotiatios with the purpose of draw up a contract of lease.

In any case, Dotstay does not guarantee the good result of negotiation nor will be consider responsable for any incpnvenience resulting by the user-owner iteraction.

ART. 4 – DOT

User, for the purpose of booking the Service, needs to book one of any available DOT on the Website during the selected week. Is not possible, in any case, use the Service without a valid and real reservation of a “DOT” temporary accomodation.

In regard the conditions of reservation and any other rules applicable to the DOT, it is all senr back to what is established in the General Conditions Section.

ART 5 – Limitation of liability

User accept and declair on being aware that Dotstay in commit to offer the best service with the purpose of give the best way to reach the goal, buti s not responsible and, therefore, is not giving any guarantee in relation with the good result of any agreement or negotiation coming from the interaction between user and the accomodation’s owner and/or roommate, even after the users check-in in the selected accomodation.

Users agree that Dotstay can not be considered responsible and, therefore, in not going to give any kind of guarantee according to the behavior of the owner and/or roommate, relogious orientation, sexsual or any other kind. Dotstay is not responsible of any kind of disagreement between users and roommate and/or accomodation owner, after the check-in in the selected accomodation.

User, futhermore, relieve Dotstay from any responsibility if the required data for the check-in is over 20 (twenty) days from the tour of the accomodation and the owner request the payment of the period between above-mentioned data and the check-in data in the room/accomodation.

ART. 6 – Payment

The service is totally for free. However, user, have to book a DOT according to the rules of reservation and payment inserted in Generals Conditions.

ART. 7 -  Cancellation of the Service

The cancellation of the Service follow the rules fixed for the reservation and cancellation of DOT, from where you are totally send back. By virtue of, the booking of the Service and the corrispondent DOT are not refundable nor erasable if done less than 7 (seven) solar days befor expected check-in data.

Are not, furtheremore, refundable the amounts collected by Dotstay in case of earlyer check-out.

ART. 8 – Applicable law

User accept the application of italian law regarding location topic, required safekeeping, and payment method of the room/accomodation lease, and declare of being concious that above-mentioned has no reference to Dotstay and to the Service.

In accordance and valid for law purpose of ART. 1341, second clause, users declare to have taken vision and to approve and to accept specifically above-mentioned Articles and Generals Conditions.

TERMS AND CONDITIONS PREMIUM SERVICE

Concerning to the conditions about the Premium Service, they are totally refered to the rules fixed for the reservation, using, payment and cancellation of DOT, contained in the General Terms of Service of the website.

For all the rules concernig Smart service, they are send back to the related Terms and Conditions.
